Terms and Conditions

1. Introduction

Welcome to Mind.me. These Terms and Conditions govern access to and use of the Mind.me platform, a Software as a Service (SaaS) solution designed to support mental health professionals and organizations in managing clinical information, organizing patients, documenting sessions, managing teams, and using intelligent features that support professional practice. By creating an account, subscribing to a plan, or using the platform, the User declares that they have read, understood, and fully accepted these Terms and Conditions. If you do not agree with these terms, you must not use the platform.

2. Service Description

Mind.me is a digital platform made available through the internet, accessible through authentication and intended exclusively for professional use. The platform may provide features such as: • Patient management; • Session management and documentation; • Clinical team management; • Document management; • Knowledge Base; • Intelligent clinical support features; • Administrative tools; • Other features made available as the product evolves. Mind.me reserves the right to modify, add, or remove features at any time.

3. Eligibility and Professional Use

Mind.me is intended exclusively for: • Psychologists; • Clinics; • Private practices; • Mental health organizations; • Other professionals duly qualified to operate within the mental health sector. By using the platform, the User declares that they are acting within the scope of their professional or business activities. The platform is not intended for end consumers or for personal or household use.

4. Account Creation and User Responsibility

The User agrees to: • Provide accurate, complete, and up-to-date information; • Maintain the confidentiality of their login credentials; • Use secure passwords; • Immediately notify Mind.me of any unauthorized use of their account. The User is responsible for all activities carried out through their account.

5. Clinic and Team Organization

The platform allows the creation of organizational structures composed of: • Clinic administrators; • Administrative assistants; • Healthcare professionals; • Other roles that may become available in the future. Each organization is responsible for the proper assignment of permissions and access rights to its users. Mind.me shall not be responsible for incorrect configurations performed by users themselves.

6. Artificial Intelligence and Clinical Support

Mind.me may provide features powered by artificial intelligence to support the organization and consultation of information. Such features may include, among others: • Information summaries; • Note organization; • Knowledge consultation assistance; • Contextual assistance. The User acknowledges and agrees that: • AI features may generate incorrect, incomplete, or outdated results; • Generated results do not constitute clinical advice; • Generated results do not constitute a diagnosis; • Generated results do not constitute treatment; • Final validation of all information remains the responsibility of the healthcare professional. All clinical decisions remain the sole responsibility of the User.

7. Clinical Responsibility

Mind.me is a technological tool designed to support professional practice. The platform does not provide healthcare services. The platform does not establish any therapeutic relationship with patients. All clinical activity carried out through the platform remains the sole responsibility of the respective professionals. The User is solely responsible for: • Clinical assessments; • Diagnoses; • Treatment plans; • Interventions; • Clinical decisions; • Communication with patients.

8. Patient Data

The User guarantees that they have an appropriate legal basis for collecting, storing, and processing the data entered into the platform. The User further undertakes to comply with all applicable legislation regarding personal data protection and professional confidentiality. Mind.me acts as the provider of the technological infrastructure and does not assume responsibility for clinical decisions or for the lawfulness of the data processing carried out by its customers.

9. Plans, Subscriptions, and Payments

Use of the platform may depend on subscribing to a paid plan. The features, pricing, and limitations of each plan are described on the Mind.me pricing page. Payments are processed through external payment service providers. Prices may be changed in the future upon prior notice to affected customers.

10. Trial Period

Mind.me may provide free trial periods for new users. Unless otherwise stated, the trial period lasts for 7 days. Mind.me reserves the right to modify, limit, or discontinue promotional campaigns or free trial periods.

11. Renewal and Cancellation

Subscriptions automatically renew at the end of each contracted period unless cancelled in advance by the User. Cancellation takes effect at the end of the already paid subscription period. Unless otherwise required by mandatory law, amounts already paid are non-refundable. Following cancellation, certain features may become unavailable, while data may be retained for the period specified in the Privacy Policy or required by legal obligations.

12. Acceptable Use

The User agrees not to: • Use the platform for unlawful purposes; • Attempt to gain unauthorized access to systems; • Interfere with the operation of the platform; • Introduce malware, viruses, or malicious code; • Use the platform to process information without a valid legal basis; • Improperly share access credentials. A breach of this clause may result in the suspension or termination of the account.

13. Intellectual Property

All rights relating to the Mind.me platform belong to Mind.me or its respective licensors. This includes, among others: • Software; • Design; • Interfaces; • Logos; • Trademarks; • Content; • Documentation. None of these elements may be copied, reproduced, distributed, or exploited without prior written authorization.

14. Service Availability

Mind.me will make reasonable efforts to ensure high levels of platform availability. However, it does not guarantee uninterrupted or error-free operation. Interruptions may occur due to: • Maintenance; • Updates; • Technical failures; • Third-party services; • Events beyond Mind.me's reasonable control.

15. Limitation of Liability

To the fullest extent permitted by law, Mind.me shall not be liable for: • Loss of revenue; • Loss of profits; • Loss of data; • Indirect damages; • Consequential damages; • Clinical decisions made by users; • Improper use of AI-powered features. Mind.me's total liability shall not exceed the amount effectively paid by the customer during the 12 months preceding the event giving rise to the claim.

16. Data Protection and Confidentiality

The processing of personal data is governed by the Mind.me Privacy Policy. Mind.me undertakes to implement appropriate technical and organizational measures to protect information processed through the platform.

17. Changes to the Terms

Mind.me may update these Terms and Conditions at any time. Any changes shall become effective upon publication on the website or communication to users. Continued use of the platform after such changes take effect constitutes acceptance of the updated terms.

18. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by Portuguese law. Any dispute arising from the use of the platform shall be submitted to the competent Portuguese courts, without prejudice to any applicable mandatory legal provisions.
